TAG-KLOI (together with our affiliates and subsidiaries, "we", "us", or "our”) has created this Privacy Notice to inform you about how we process the information we collect from and about you when you visit our website located at www.tagkloi.com (the "Site"), access our mobile applications ("Mobile App"), purchase any of our ("Products"), attend our events, or use any of our services, features, or other offerings (collectively, the “Services”).

Purpose of this privacy notice: This privacy notice aims to inform you how TAG-KLOI collects and processes your personal data, including any data you may provide through our website, when you sign up to our newsletter, purchase a product or take part in a competition. It is important that you read this Privacy Notice together with any other privacy notice or fair processing notice that we may provide on specific occasions, when we are collecting or processing personal data about you, so that you are fully aware of how and why we are using your data. This privacy notice supplements other notices and privacy policies and is not intended to override them.

Controller: TAG-KLOI, in its capacity as a data controller, is extremely sensitive to the protection of personal data and will carry out the protection, processing, deletion, destruction or anonymization of the personal data you share with the Company in full compliance with the provisions of the Personal Data Protection Law No. 6698 ("PDPA") and all related legislation. When we mention, “Company”, “We", "Us" or "Our", we are referring to TAG-KLOI.

It is important that the personal data we hold about you is accurate and current. Please inform us if your personal data changes during your relationship with us or alternatively you can amend your details by logging into your account on the 'Sign in' section of our website.

Third-Party Links: Our website may include links to third-party websites, plug-ins and applications. The Data We Collect About You

TAG-KLOI obtains personal data from its customers by automatic or non-automatic methods. All kinds of written, verbal and electronic media, third parties and / or legal authorities for the purposes and the services we offer within the framework of the legal regulations to which our Company is subject. In addition to it in order to fulfil our obligations under the contracts established with the relevant persons or with the explicit consent of the relevant individuals when necessary in connection with the purpose of the purchase. Your personal data collected by these methods can be processed and transferred for the following purposes within the framework of the personal data processing conditions of the PDPA.

Personal data, or personal information, means any information about an individual from which they can be identified. It does not include data where the identity has been removed (anonymous data). We may collect, use, store and transfer different kinds of personal data about you which we have grouped together as follows:

  • Identity Data: can include first name, maiden name, last name, username or similar identifier, social media profile information, marital status, title, Government ID or Passport details as and when required for international couriers, date of birth and gender.
  • Contact Data can include: billing address, delivery address, email address and telephone numbers.
  • Financial Data can include bank account and payment card details.
  • Transaction Data can include details about payments to and from you and other details of products you have purchased from us.
  • Technical Data: can include internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access this website.
  • Profile Data: can include your username and password, purchases or orders made by you, your interests, family details, preferences, feedback and survey responses.
  • Usage Data: can include information about how you use our website and products.
  • Marketing and Communications Data: can include your preferences in receiving marketing from us and our third parties and your communication preferences.

We also collect, use and share Aggregated Data such as statistical or demographic data for the purpose of carrying out our business. Aggregated Data may be derived from your personal data but is not considered personal data under the law as this data will not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific website feature. However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data and that will be used in accordance with this privacy notice.

We do not ask for and collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data). Nor do we collect any information about criminal convictions and offences.

Where we need to collect personal data by law, or under the terms of a contract we have with you, and you do not provide that data when requested, we may not be able to perform the contract we have or are trying to make with you (for example, to provide you with goods). In this case, we may have to cancel an order which you have placed with us but we will notify you if this is the case at the time.

 

How Your Personal Data is Collected?

We use different methods, to collect data from and about you including through:

Direct interactions. You may provide us your Identity, Contact and Financial Data by filling in forms or by corresponding with us by post, phone, e-mail or otherwise. This includes personal data you provide when you:

  • apply for our products;
  • create an account on our website;
  • subscribe to our publications;
  • request marketing to be sent to you;
  • enter a competition, promotion or survey; or
  • give us some feedback.

How We Use Your Personal Data

We will only use your personal data when the law allows us to. We will use your personal data in the following circumstances:

  • When we need to perform the contract we are about to enter into or have entered into with you.
  • Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.
  • Where we need to comply with a legal or regulatory obligation.

Generally, we do not rely on consent as a legal basis for processing your personal data although we will get your consent before sending you third-party direct marketing communications via email or text message. You have the right to withdraw consent to our direct marketing at any time by contacting us.

 

Disclosure of Your Personal Data

We operate globally and may transfer, store, and/or process your information to or with other entities within the company or other third parties such as trusted service providers and partners in locations around the world for the purposes described in this Privacy Notice. Wherever your information is transferred, stored or processed by us, we take reasonable steps to protect your information in accordance with this Privacy Notice and applicable laws. These measures may include implementing Standard Contractual Clauses to govern the transfer of your information, or other means recognized by applicable laws.

Data Security

We have put in place appropriate security measures with the aim of preventing your personal data from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

We have established procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

 

Data Retention

We will only retain your personal data for as long as is reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe, there is a prospect of litigation in respect to our relationship with you.

To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from un-authorized use or disclosure of your personal data. In addition, we consider the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.

By law, we must retain basic information about our customers (including Contact, Identity, Financial and Transaction Data) for 10 years after they cease being customers for tax purposes. In some circumstances, you can ask us to delete your data: see your legal rights below for further information.

In some circumstances we will anonymize your personal data (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.

Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object your personal data for direct marketing purposes. Request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data in the following scenarios: (a) if you want us to establish the data's accuracy; (b) where our use of the data is unlawful but you do not want us to erase it; (c) where you need us to hold the data even though we no longer require it as you need it to establish, exercise or defend legal claims; or (d) you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.

Request the transfer of your personal data to you or to a third party. We will provide to you, or a third party you have designated, your personal data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.

Withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent.
